FAQs

What is a housing disrepair claim
and how do I start one?

A housing disrepair claim is when action is taken by tenants against their landlords if the landlord has failed to keep the property in a habitable condition.

Once you have notified your landlord (in writing) of the issues in your home and they have not addressed or resolved the issues within a reasonable time frame, you can submit the form on our website to find out if you are eligible.

What is the time limit to make a housing disrepair claim & what evidence do I need?

It will depend on the severity of the claim, if the claim involves personal injury then the time limit is usually 3 years but for other HDR claims, the limit is usually 6 years.

It is important to keep any correspondence that you have with your landlord, including photographs, records of complaints made and especially medical records if the disrepair in your home has directly impacted your health.

Will I have to pay for repairs if I make a claim?

Your landlord is solely responsible for making repairs. If you claim and win, your landlord is responsible for fixing the repairs.

Can my landlord evict me for making a housing disrepair claim?

No, it is illegal for landlords to evict tenants for making a disrepair claim.

Case Study

Client's Situation:

Our client, a tenant, faced severe damp and mould across their rented property, creating unhealthy living conditions. Despite repeated complaints, the landlord failed to act. With the property deteriorating and health risks increasing, the client needed urgent legal intervention but required a solution that avoided upfront costs.

Outcome/Justice & Compensation:

Operating on a No Win, No Fee basis, our specialist housing disrepair team, led by solicitor Ismail Limbada, swiftly took action. Using the client’s evidence (including photographs), we compelled the landlord to accept responsibility. Within months, we secured full repairs to eradicate the damp and mould, and achieved significant compensation for the client. The tenant successfully resolved their disrepair claim and secured justice without any personal financial outlay.

*Figures gathered by Inside Housing show that this is a nationwide trend. Across 70 English councils that own their own stock, there have been nearly 17,000 disrepair claims in the past five years, with more than £55.1m paid out. However, the figures will be much higher because about 100 councils did not provide data. Average payout is £6,512.

*Please note: Our solicitors have successfully secured compensation amounts up to £10,000* in housing disrepair cases. However, individual outcomes may vary, and the final compensation awarded could be more or less than this figure.

**No Win No Fee** typically customers pay 25% including VAT of the amount recovered to our solicitors, although this will be subject to your individual circumstances and the actual fee may be more or less than this. If you cancel the claim after the cooling-off period of 14 days you may be charged a cancellation fee by the solicitor.
